Also, we do not share identifiable personal information (such as your name, email, or other contact information) with advertisers unless you give us explicit permission. Our approach allows advertisers to define their desired audience, and we then present ads to members who fit this profile. How HeyHorse is Funded

HeyHorse’s goal is to help connect the community and make the equestrian life easy and enjoyable for people and the horses. To bring this to life, HeyHorse generates revenue from two main streams:

Our service operates on a subscription basis. Enjoy a range of features and services with our monthly or annual plans.

Personalized Ads

You will see personalized ads and sponsored content. Businesses and organizations pay us to show these ads on HeyHorse. We use information like what you do and what you like to make these ads more relevant to you.

Ads Tailored to You, Keeping Privacy Intact

Our advertising system is designed to prioritize your privacy. We present you with relevant ads without compromising your identity to advertisers. Your personal data is not for sale. Advertisers specify their target audience criteria, such as horse enthusiasts aged 18-35, and we then display these ads to members who fit this profile, all while keeping your personal information secure and private.

Performance Reports for Advertisers

We assist advertisers by providing insights into the performance of their ads. For instance, we might inform them about the number of women aged 25-34 in California with an interest in horse tack who viewed their advertisement. We do not disclose identifiable personal details, such as your name or email address, to these advertisers without your explicit consent.

Your Responsibilities on HeyHorse

We offer HeyHorse services to support our mission and community. In return, we ask you to commit to the following:

Who Can Use HeyHorse

Be Real and Responsible: It's important to use your real name, share accurate information about yourself, maintain just one personal account, and safeguard your password, ensuring no one else has access to your HeyHorse account.

Age and Legal Restrictions: You need to be at least 13 years old to use HeyHorse. Additionally, if you are a convicted sex offender, have had your account disabled due to a breach of our terms, or are legally barred from using services like ours, then you are not permitted to use HeyHorse.

Sharing and Behavior Guidelines

Play by the Rules: Engage in lawful and honest activities. Share only content that you own or have permission to use. Be mindful and respectful of others' rights, especially concerning intellectual property.

Spread Positivity and Do No Harm: Keep the digital environment healthy - no spreading viruses, spam, or anything that could damage HeyHorse or disrupt others' enjoyment. Also, please don't gather data from HeyHorse without our permission.

Use Access Wisely: Be responsible with usernames, passwords, and access tokens. Gathering, buying or selling data from HeyHorse is not authorized.

Respect Our Systems: Don’t misuse our reporting or appeals processes.

Consequences for Violations

Content Moderation and Account Access: Should any rules be broken, we might have to remove content or limit access. Repeated or serious violations could lead to account suspension or even termination.

Notification and Review: If we remove your content, we’ll let you know and explain how you can request a review, unless it poses legal risks or harms our community.

Reporting and Compliance

Community Support: If you come across anything that breaks these rules, let us know.

Legal and Regulatory Compliance: We may remove or restrict access to content or features to comply with legal or regulatory requirements.

Permissions You Give to HeyHorse

When you use HeyHorse, you give us certain permissions to help run our services:

Using Your Content

Ownership Stay with You: Anything you create and share on HeyHorse, like photos and videos, is yours. You retain all your ownership rights.

License: To help us provide and improve our services, you give us permission (a license) to use your content. This doesn’t change your ownership rights.

Understanding the License: Let's say you share a photo. You're allowing us to store, duplicate, and share it with others, but always respecting your privacy settings. This license is no longer valid once you remove your content from our platform.

Deleting Your Content

In Your Hands: If you decide to delete your account, it will erase all of your personal content. But keep in mind, anything you've shared in group spaces, like photos in shared albums, might still be visible to other members.

Data Deletion Timeline: Removing your content from HeyHorse can take up to 90 days. During this period, your content won't be visible to other users. It might take another 90 days to completely erase it from our backup systems.

Exceptions to Immediate Deletion

Others Using Your Content: If others haven't deleted your content they used, the license continues until they delete it.

Technical Limitations: If technical issues delay deletion, we’ll do it as soon as possible.

Legal and Safety Reasons: We might keep content longer for legal reasons, to help with investigations, ensure safety and security, or comply with legal obligations.

Your Identity in Ads and Sponsored Content

When you interact with ads or sponsored content on our platform, you are giving HeHorse permission to use your name and profile picture. For instance, we might display to other members that you liked a particular post or are interested in an event. Only those whom you've permitted to view your activities will see these ads. It's important to note that this use of your name and image is without any financial compensation to you.

Software Updates

Automatic Updates: If you download or use our software, you agree to automatically receive updates when they’re available.

As you engage with HeyHorse, it's important to understand our content policies and your rights:

Our Content in Your Posts

What We Own: If you use images, designs, videos, or sounds from HeyHorse in your posts, remember, we own that content.

Your Content is Yours: You keep the rights to the content you create and share.

Using Our Copyrights and Trademarks

Please enjoy the great features available on HeyHorse, but remember that these remain our property. You should use them according to our guidelines. Modifying, translating, creating new versions, or dissecting our products or their components to inspect the code is not allowed, unless the law explicitly allows it.

Account Suspension or Termination

Reasons for Account Suspension or Termination on HeyHorse

Maintaining a Positive Community: Our goal is to keep HeyHorse a welcoming and safe place for everyone. Therefore, serious or repeated violations of our Terms or Policies, particularly our Community Guidelines, may lead to the suspension or even permanent closure of your account.

Respecting Legal and Intellectual Property Rights: Persistent infringement of others' intellectual property rights, or legal requirements, may necessitate the closure of your account.

Account Management Issues: We may also need to suspend or close your account if it has not been verified, has been inactive for an extended period, or if there's evidence of unauthorized use.

You Will Be Notified

Notification: If your account is suspended or closed, we'll make attempt to inform you and outline the options available for requesting a review. However, this might not be possible in cases where it could lead to legal issues, harm our community, or disrupt our services.

Addressing Potential Errors

Getting Help: If you believe your account was disabled by mistake, please reach out to us at support@heyhorse.co. We can guide you through the necessary steps to potentially rectify the situation.

What Happens After Closure

Continued Terms Applicability: Even if your account is deleted or closed by us, our agreement under these Terms ceases. However, certain sections of the Terms may still remain in effect.

Account suspension or closure is a measure we take to maintain a positive and secure environment on HeyHorse. If you find yourself in this situation, know that there is a procedure to address it, and we are here to assist you through the process.

Limits on Liability

HeyHorse is dedicated to delivering incredible Products and have set clear guidelines for their use. However, please understand that our Products are offered "as is." While we aim for them to be safe, secure, and free of errors, we cannot guarantee that they will always function without any errors, disruptions, or imperfections.

To the extent the law allows, we DISCLAIM ALL WARRANTIES, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Remember, we do not have control over, nor are we responsible for, the actions or content of users, whether it's their conduct, online or offline, or any content they share, even if it's offensive, inappropriate, or objectionable.

Unforeseen issues can arise with our Products, and in such instances, our liability is limited to the maximum extent permitted by law. We are not liable for any loss of profits, revenues, information, or data, nor for consequential, special, indirect, exemplary, punitive, or incidental damages linked to these Terms or the HeyHorse Products. This applies regardless of the nature of the liability, including negligence, even if we've been advised of the possibility of such damages. Our total liability related to these Terms or the HeyHorse Products won't exceed the greater of $100 or the amount you've paid us in the past twelve months.

Acknowledgement of Risks: We would like to remind all users that interacting with and being around horses can involve inherent risks. Despite all safety measures, accidents, injuries, and even fatal incidents can occur. Users should always be aware of these risks and engage in horse-related activities with caution and at their own risk.

Limitation of Liability for Information Provided: The information provided in HeyHorse products, including but not limited to advice, tips, and guidelines, is intended for general informational purposes only. HeyHorse does not assume liability for any actions taken based on this information, and users agree to hold HeyHorse harmless from any claims, losses, damages, or negative outcomes that may result from the information obtained from our products. Users should always seek professional advice when needed.

Managing Disputes

Our goal is to establish clear rules to reduce the chances of disputes. However, it's important to know how any disagreements will be addressed.

Resolving Disputes: Location and Legal Framework

Jurisdiction: Disputes relating to these Terms or your use of HeyHorse Products will be resolved in the U.S. District Court for the Northern District of California.

Governing Law: Disputes will be governed by California law, irrespective of its conflicts of law principles.

Court Proceedings: By using HeyHorse, you consent to resolve any such disputes in these courts.

HeyHorse's Approach to Legal Matters

Legal Actions: If necessary, HeyHorse reserves the right to initiate legal proceedings against you in your own country.

Other Terms

This document represents the entire agreement between you and HeyHorse, LLC concerning your use of our Products. It supersedes all prior agreements or understandings.

Some of our Products come with additional terms. If you use these particular services, those extra terms become an integral part of our agreement with you.

In cases where there is a discrepancy between these general Terms and the supplemental ones for specific Products, the supplemental terms will take precedence.

Enforceability and Amendments

If any part of these Terms is deemed unenforceable, that section will be modified as little as necessary to make it enforceable. If it cannot be made enforceable, it will be removed, while the rest of the Terms remain effective and intact.

Not enforcing a part of these Terms doesn’t mean we waive our right to do so later. Also, any changes to these Terms or any waivers need to be in writing and officially signed by us to be valid.

These Terms are strictly between you and HeyHorse, LLC. They don't give rights to any third parties.

We reserve the right to transfer our rights and obligations under these Terms. This can happen in cases of a merger, acquisition, sale of assets, by law, or through other means.

Changing Usernames: We might change your username in specific situations, like trademark claims.

We appreciate when you share your ideas and feedback with us. If you do share them, we might use these ideas and suggestions freely, and we're not obligated to offer compensation or keep them confidential.

We reserve all rights not expressly granted to you.
